Terms of service

These terms govern the purchase of services from Ekualia, a trading name of MDE HUB, S.L. (Tax ID B27582428, C/ de la Borrasca 19, 14-L, 46014 Valencia). The proposal or quote accepted by the client prevails over these terms where it specifically provides otherwise.

1. Services

  • Full Control plans (Start, Grow and Full Control 360): a monthly online-marketing operations service with the scope described on the website and in the proposal.
  • Solutions, each with three levels of fixed scope and price published on the website, or with a custom quote: one-off projects (for example websites, brand identity, applications, online stores, automations, audits, strategy or analytics) and monthly-fee services (for example SEO, digital advertising, social media, content, email, AI visibility, AI chat and voice agents, or maintenance).

2. Term, pilot and 30-day guarantee

Plans and monthly-fee services start with a 90-day pilot (three monthly fees) with agreed targets. After that they continue month to month and the client may cancel with 30 days' notice by writing to info@ekualia.com. The first fee is charged on purchase.

30-day guarantee: within 30 days of the first payment the client may cancel by writing to info@ekualia.com; in that case the first fee is refunded in full and the contract ends with no penalty. The guarantee does not cover ad spend, which the client pays directly to each platform, or one-off projects, which are governed by section 3.

Compliance and Tracking Audit: paid once. If the client takes a plan within 30 days of paying for it, its price is deducted from the plan's first fee.

3. Price and payment

Prices exclude VAT, which is added at payment where applicable. Payments are processed by Stripe; Ekualia does not store card details.

  • Monthly fees and plans: charged in advance each month to the payment method provided at purchase.
  • One-off projects: 50% upfront and 50% on delivery. For projects over €5,000, 40% upfront, 30% at the agreed interim delivery and 30% on final delivery. Payments after the first are invoiced with a payment link due in 15 days.
  • The upfront payment for a project is refunded if the client cancels before work starts. Once work has started, the client may request revisions before approving each delivery.

Ad spend (Google, Meta or other platforms) is paid by the client directly to each platform and is not part of the fee.

4. Ownership of accounts, data and deliverables

Ad, analytics, domain and website accounts are created or kept in the client's name. Ekualia accesses them with the permissions the client grants and returns them at the end. Paid deliverables (copy, designs, code, videos) belong to the client; Ekualia keeps its tools, methods and generic components.

5. Use of AI

Ekualia uses artificial-intelligence tools to execute and measure its work, always with human review before publishing or changing anything significant. Client data is not used to train generalised AI models. See Security and data.

6. Data protection

When Ekualia processes personal data on the client's behalf it acts as a data processor under Article 28 GDPR and signs a data processing agreement with the client. See the Privacy policy.

7. Confidentiality

Both parties will keep confidential any information they access in the course of the service, including after it ends.

8. Client obligations

Provide access, information and approvals on time; ensure it holds rights to the content it supplies; and comply with the regulations applicable to its business and advertising.

9. Liability

Ekualia provides its services with due professional care but does not guarantee specific results from third parties (ad platforms, search engines or AI assistants). Its total liability is limited to the amount paid by the client in the 12 months before the event giving rise to it, except in cases of wilful misconduct or gross negligence.

10. Termination

Either party may terminate the contract for a material breach by the other not remedied within 15 days of written notice.

11. Governing law and jurisdiction

Spanish law applies. The parties submit to the courts of Valencia, unless consumer law provides otherwise.
